REGULATIONS OF INTERNATIONAL 330 TRADING PLATFORM

REGULATIONS FOR THE ELECTRONIC PROVISION OF AGENCY SERVICES

§ 1

General

  1. These regulations define principles governing the electronic provisions of agency services by the Agent in making contracts of sales between Sellers and Buyers.
  2. The agency services are provided by International Trading Platform 330 at www.330.pl or other websites provided by International Trading Platform 330 with its principal place of business in Berlin, Westhafenstr.1 13353 Berlin.
  3. Technical requirements for cooperation with International Trading Platform 330 are as follows: a computer with Internet access, an Internet browser such as Internet Explorer 6 (or newer) lub Mozilla Firefox 2.0 (or newer). The subjects of the sales contracts assisted by the Agent are goods offered by individual suppliers presented at www.330.pl or others given by the Agent.

  5. The prices of all the merchandise offered at www.330.pl or other webistes are expressed in Polish zlotys and euro.
  6. 5. Natural persons with full legal capacity, legal entities and organization entities without legal capacity may use the services provided by the Agent.

§ 2

How to use the agency services

  1. The Buyer intending to use the services provided by the Agent shall fill in the registration form available at www.330.pl or other websites and send the form via email or the Agent’s consultants.
  2. Once the Buyer has filled in the registration form, it shall be understood that the Buyer has familiarized himself or herself with the contents hereof and accepts them.
  3. The Agent shall send logins A and B along with an access password to International Trading Platform 330 to the email the Buyer has entered in the registration form within two (2) days of the date of entering the email address by the Buyer.
  4. Having received the logins and the access password needed to log on International Trading Platform 330, the Buyer may order a search of offers available on the Platform (these may be car, machine, appliance and other sales offers which meet the Buyer’s expectations).
  5. The Buyer must not write the Buyer’s personal data on the search order.
  6. The Agent performs the activities related to the search orders mentioned in item 4 of this section without charge.
  7. If the Agent finds a car, machine, appliance or other merchandise which satisfy the Buyer’s expectations, the Agent presents the search results electronically on “My inquiries and responses” panel.
  8. Having typed in the logins and the password, the Buyer shall access the above-mentioned search results.
  9. Shall the Buyer initially accept an offer presented to the Buyer, the Buyer shall confirm the Buyer’s choice by booking the offer.
  10. Having booked the offer, the Buyer may confirm the reservation for a period of twenty-four (24) hours.
  11. The moment the Seller confirms the reservation, the Buyer shall confirm the initial acceptance by clicking on “Confirmation of the offer’s initial acceptance.”
  12. If the Buyer fails to answer within twenty-four (24) hours, the Seller shall cancel the reservation.
  13. Once the Buyer confirms the offer’s initial acceptance successfully, the Agent shall send the Seller’s contact data along with a pro forma invoice to “My transactions” panel.
  14. The contract of sales between the Buyer and the Seller shall be made when the Seller makes the Buyer a sales offer accepted by the latter.
  15. The contract shall not be made electronically, but in the presence of both parties at a place designated by them.
  16. It is the Seller who shall deliver the subject of the sales contract as well as documents related to the product to the Buyer.
  17. If the contract of sales is not made within five (5) days of the receipt of the Seller’s contact data by the Buyer, the whole procedure of making the sales contract shall be null and void.
  18. Once the Seller makes the contract of sales, the Seller is obliged to inform the Agent about it.

§ 3

The Agent’s Liabilities

  1. The Agent shall not be liable for the contents of the search orders issued by the Buyer. Neither shall the Agent be liable for the Seller’s responses to those queries.
  2. The Agent shall not be liable for any physical or legal defects of the sold item.
  3. The Agent shall not be liable for any failure to provide services shall the failure be caused by technical problems or problems on the part of the Seller.
  4. The Agent asserts the right to refuse to provide agency services without giving reasons, whereby the Agent shall inform the Buyer about the refusal in writing by sending a note to the email entered by the Buyer in the registration form.

§ 4

Privacy Policy

  1. Upon filling in the registration form, the Buyer agrees that the Buyer’s personal information be processed.
  2. Personal information is stored in such a manner that no third parties shall gain access to it.
  3. The Buyer, in order to protect the Buyer’s personal information and prevent the third parties within the reach of the Buyer’s computer from accessing the Buyer’s account, shall apply the “Log out” option any time the Buyer quits International Trading Platform 330’s system.
